1. Agreement to Terms

Welcome to Inheritor. These Terms and Conditions ("Terms") govern your use of the Inheritor mobile application and any related services (collectively, the "Service"), provided by Inheritor BV (the "Developer"). By downloading, accessing, or using our Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Description of the Service

Inheritor provides a non-custodial software interface that enables users to create on-chain digital inheritances using blockchain smart contracts and permanent distributed storage. The Service enables you to:

  • Create Digital Inheritances: Designate beneficiaries and create tokenized inheritances with cryptographically enforced conditional access.
  • Store Encrypted Assets: Store any sensitive information with quantum-safe encryption on permanent decentralized storage (Arweave).
  • Manage Check-ins: Confirm your wellbeing through periodic check-ins that control inheritance state transitions.

The Service is an interface only. We do not store, control, or have custody over your private keys, encryption keys, data, or digital assets.

3. No Legal, Financial, or Tax Advice

Inheritor is a technology tool. The Service does not constitute legal, financial, security, or tax advice. You are solely responsible for seeking professional advice from qualified experts in your jurisdiction. Inheritor complements but does not replace traditional legal instruments where required.

4. User Responsibilities

4.1. Encryption Key and Backup Responsibility

Your encryption keys control access to your inheritances. You are solely responsible for the security and backup of your quantum-safe encryption keys. We have no ability to access or recover them.

  • X-Wing keys sync automatically via Apple iCloud Keychain (if enabled).
  • You may optionally export and securely store your encryption keys.
  • If you lose access to your encryption keys, your encrypted data will be permanently inaccessible.
  • Self-Custody: You are in full control of and responsible for your encryption keys and inheritance data.
  • Transaction Responsibility: You are responsible for all transactions you initiate, including verifying data before uploading to Arweave.
  • Data Permanence: Data uploaded to Arweave is permanent and cannot be deleted.
  • Check-in Responsibility: You are responsible for maintaining your check-in schedule to prevent unintended inheritance releases.
  • Legal Compliance: You agree to comply with all applicable laws in your jurisdiction.

5. Acknowledgment of Risks

The Service is provided "as is" and "as available" without any warranties. We disclaim all liability for any loss or damage arising from:

  • Loss, theft, or compromise of your encryption keys or private keys
  • User error, such as uploading incorrect data or losing encryption keys
  • Failure of any third-party service (iCloud Keychain, Arweave network, Ethereum/Arbitrum networks)
  • Missed check-ins resulting in unintended inheritance releases
  • Regulatory changes or enforcement actions
  • Future cryptographic breakthroughs

6. Service Continuity

The Service is architected to minimize reliance on the Developer. If Inheritor ceases operations, we provide publicly documented recovery scripts on GitHub. Your inheritances operate through public blockchain infrastructure and will continue to function independently of the Inheritor company.

7. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL INHERITOR BV BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF CRYPTOCURRENCY, DIGITAL ASSETS, ENCRYPTION KEYS, DATA, OR PROFITS. TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED $100.00 USD.

8. Intellectual Property

We grant you a limited, non-exclusive, non-transferable, revocable license to use the Inheritor application for your personal use. All rights, title, and interest in the Service remain the exclusive property of Inheritor BV. The Architectural Time-Lock technology is patent pending.

9. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of significant changes through the app or our website. Your continued use constitutes acceptance of the new Terms.

10. Governing Law

These Terms shall be governed by the laws of The Netherlands. Any dispute shall be resolved by arbitration in Amsterdam, The Netherlands, before a single arbitrator administered by the Netherlands Arbitration Institute (NAI).
